By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Responsible Gambling information. We reserve the right to modify these Terms at any time. Continued use of the App following any changes constitutes acceptance of the updated Terms.

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are 18 years of age or older. We reserve the right to request proof of age at any time and to suspend or terminate accounts where the user is found to be under 18. The App is intended for use by residents of Australia. Access from other jurisdictions is at the user's own risk and responsibility.

To access certain features of the App, you must create an account. You agree to: • Provide accurate, current, and complete information during registration • Maintain the security of your account credentials • Notify us immediately of any unauthorised access to your account • Accept responsibility for all activity that occurs under your account We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms or for any other reason.

The App provides free-to-enter tipping competitions for sports and racing events. Important points regarding competitions: • All tipping competitions on BTFU are free to enter. No real money is wagered, staked, or risked through the App. • BTFU does not facilitate, promote, or enable real-money gambling. • Competition results are determined by the outcomes of real sporting and racing events. • Prizes, if any, are awarded at the sole discretion of BTFU and are subject to separate prize terms and conditions. • We reserve the right to modify, suspend, or cancel any competition at any time without notice. • Decisions regarding competition results, scoring, and prize allocation are final. • All competitions are sponsored solely by BTFU Pty Ltd. Apple Inc. is not a sponsor of, and is not involved in, any BTFU competition in any way. • Eligibility: You must be 18 years of age or older and an Australian resident to participate.

When using the App, you agree not to: • Use the App for any illegal or unauthorised purpose • Attempt to gain unauthorised access to other users' accounts or our systems • Interfere with or disrupt the App's functionality or servers • Submit false, misleading, or fraudulent information • Use automated tools, bots, or scripts to interact with the App • Harass, abuse, or harm other users through messages or other interactions • Impersonate another person or entity • Use the App in any way that could damage, disable, or impair the service • Violate any applicable local, state, national, or international law

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, audio, video, software, and the BTFU brand — are the exclusive property of BTFU Pty Ltd or its licensors and are protected by Australian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any of our intellectual property without prior written consent from BTFU.

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that: • The App will be uninterrupted, secure, or error-free • Results obtained from use of the App will be accurate or reliable • Any defects in the App will be corrected Sports and racing information provided in the App is for informational and entertainment purposes only. We do not guarantee the accuracy of odds, results, or other sporting data displayed in the App.

To the maximum extent permitted by Australian law, BTFU Pty Ltd and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from: • Your use of or inability to use the App • Any conduct or content of any third party on the App • Any content obtained from the App • Unauthorised access, use, or alteration of your data Our total liability to you for all claims arising from or relating to the use of the App shall not exceed the amount you have paid to us (if any) in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless BTFU Pty Ltd and its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any rights of another.

BTFU Pro is an optional paid subscription that provides premium features. Important details: • Payment will be charged to your Apple ID account at confirmation of purchase. • Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. • Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan. • Subscriptions may be managed by the user, and auto-renewal may be turned off by going to the user's Account Settings after purchase. • Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription. • Prices are in Australian Dollars (AUD) and may vary by region. Applicable tax may apply. We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination: • Your right to use the App will immediately cease • We may delete your account and associated data in accordance with our Privacy Policy • Any provisions of these Terms that by their nature should survive termination shall survive (including ownership, disclaimers, indemnity, and limitations of liability)

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or use of the App shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia. Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.
